Our offices are located just west of the River Park shopping center, which provides a centralized location for residents of Fresno County.  I, James D. Miller, have been practicing law for over 12 years.  I started my career with one of the largest law firms in the country and represented mainly creditors and large corporations.  Taking that experience with me, I now mostly represent debtor and small business clients.  My experience as creditor's counsel helps my debtor clients tremendously and provides them a unique perspective that other attorneys lack.  Furthermore, I pride myself on personal service that I believe goes beyond a majority of people's experiences with other attorneys.  Always accessible, I will do whatever I can to help you through these tough financial times.

BANKRUPTCY: Chapter 7 or Chapter 13

For most individuals and small businesses, Chapter 7 or 13 bankruptcy may be your answer to getting back on your feet.


Either process will help you get a control of your debt whether from credit cards, loans, medical bills, leases, deficiencies, foreclosures or judgments and get you back on your feet by stopping collection actions and wiping the debt - all while allowing you to keep most or all of your property. 


Bankruptcy can:

•    Eliminate the legal obligation to pay most or all of your debts. This is called a "discharge" of debts.
•    Stop foreclosure of your home and allow you to catch up on missed payments.
•    Stop repossession of a car or other property, or, in some situations, force the creditor to return property even after it has been repossessed.  You can even lower your car payment under certain circumstances.
•    Stop wage garnishments.
•    Stop debt collection harassment.
•    Eliminate second mortgages under certain circumstances and still keep your home.

Chapter 7


Sometimes referred to as a "liquidation" bankruptcy (but don't let the word liquidation scare you - most can keep all of their assets).  Your debts are discharged (canceled), but you must give up any nonexempt property to the trustee to pay your creditors (the key is "nonexempt asset" - a majority of people will be able to keep all of their property because of applicable exemptions).  You can keep secured property if you are current on the payments and continue making the payments regularly.  One has to qualify for Chapter 7 bankruptcy, that is, they have to be under the median income for the particular family size; otherwise, be forced to filing a Chapter 13, which is not all that bad given the options available in Chapter 13's.

Chapter 13


Also called a "reorganization," Chapter 13 allows you to keep valuable property, such as your home or car, which you might otherwise lose due to past due payments.  You can keep this type of property in Chapter 13 if you are able to make the necessary monthly plan payments.  Usually that will be the regular monthly payments plus a payment toward the arrears.  In a Chapter 13, you will have between three or five years to pay back the arrears (e.g., on your home mortgage).  You may also be able to "strip down" the second mortgage of your home and still keep your home.  Chapter 13's can be a little more complicated, thus, it is very important you find an experience and competent attorney.
